Terms of Service

These Terms of Service ("Terms") are an agreement between you and Zenith Operations LLC ("Zenith," "we," "us"), an Idaho limited liability company. They govern your use of Carousel Creator (the "Service"), including our website, the web app, and our browser extension.

By subscribing to or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service does

Carousel Creator takes real-estate listing information and photos that you provide and generates social media carousel images and a draft caption for you to review, edit, download, and post. The Service produces drafts. You decide what to publish.

2. Your account

• You sign in through Google, so your account is tied to the Gmail address you subscribe with. You must pay and sign in with the same address.
• You must be at least 18 years old.
• Accounts are for a single person. Do not share your login or let others use your account.
• You are responsible for activity that happens under your account.

3. Subscription and billing

• The Service is a paid subscription, offered at $10 per month or $100 per year.
• Payments are processed by our payment provider. We do not receive or store your full card details.
• Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel.
• You may cancel at any time through the subscription portal. Cancellation takes effect at the end of your current billing period, and you keep access until then.
• We may change pricing. If we do, we will give you notice before the change applies to your renewal.

4. No refunds

All payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or periods in which you did not use the Service. You can cancel at any time to prevent future charges.

5. Usage limits

Your subscription includes up to 10 carousel generations per day and up to 30 caption regenerations per day. These limits reset at midnight Mountain Time. We may adjust these limits, and we will give notice of material reductions.

6. Your content and your responsibilities

"Your Content" means the listing text, photos, brand details, and anything else you submit to the Service, along with the carousels and captions generated from it.

• You keep ownership of Your Content. You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely to operate the Service and produce your results.
• You confirm you have the rights to what you upload. Listing photos are frequently owned or licensed by photographers, brokerages, or an MLS. You are responsible for having permission to use every photo you submit.
• You are responsible for legal compliance in what you publish, including fair housing laws and any advertising rules that apply to you. The Service is built to help avoid common fair housing pitfalls, but it does not guarantee compliance.
• You must review every generated post before publishing. AI-generated text and image selections can contain errors, including incorrect property details. Output is a draft, not legal, marketing, or professional advice, and it does not replace your professional judgment.

7. Acceptable use

You agree not to:

• resell, sublicense, or share access to the Service;
• use bots, scripts, or other automated means to access the Service, or attempt to work around usage limits;
• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• upload unlawful or infringing content, or use the Service to send spam;
• reverse engineer or copy the Service, except where that restriction is prohibited by law.

8. Third-party services

The Service relies on third-party providers for artificial intelligence processing, payments, sign-in, and hosting. How information reaches those providers is described in our Privacy Policy. We are not responsible for the acts or omissions of third-party providers.

9. Our intellectual property

We own the Service itself, including the software, designs, slide templates, and the Zenith and Carousel Creator names and logos. These Terms do not transfer any of those rights to you. The finished carousels and captions you generate are yours to use.

10. Availability and disclaimers

The Service is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, error-free, or that generated output will be accurate, complete, or suitable for any particular purpose. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Zenith Operations LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost data, arising out of or relating to the Service.

Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

12. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, if your payment fails, or if we are required to do so by law. If we terminate your account without cause, we will not charge you for periods after termination.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and take reasonable steps to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. You and Zenith Operations LLC agree that the state and federal courts located in Idaho will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

15. Marketing communications

We may email you about Zenith Operations LLC products and services, including products other than Carousel Creator. Every marketing email includes an unsubscribe link, and you can opt out at any time. We will not call or text you for marketing purposes without your express written consent. We may always send you service messages such as receipts, security notices, and material changes to the Service. See our Privacy Policy for details.
